What is litigation and dispute resolution?

Generally speaking, when people refer to “dispute resolution,” they actually mean alternative dispute resolution (ADR). ADR methods involve using negotiation and collaborative methods to reach an outcome. Alternative dispute resolution has its place but often isn’t appropriate for every situation.

If the issues are too complex or too fraught to come to an agreement, ADR methods may not completely cover your needs.

Is dispute resolution the same as litigation?

In a sense, litigation is a form of dispute resolution, but ADR is not the same as litigation. ADR is a change of venue, method and perspective to resolve issues between parties in a more amicable way.

How long does civil litigation take?

Civil litigation can be a lengthy process as both sides come to find supporting evidence and work on their strategies. There can be delays due to continuances or evidentiary findings. Even a verdict can be placed on hold if there is an appeal.

However, litigation has the final say. If you have a legal dispute you cannot resolve in any other way, litigation is how you will get to have your voice heard and your perspective respected.
